Trump's Regime of Consequences and Incentives

Trump's insatiable urge for payback has rapidly evolved into a structured apparatus. During the past year, the president's rage and whims have taken on the shape of official policies in ways comparable to earlier authoritarian regimes. Government figures who resist his demands are summarily removed and succeeded by devotees. Critical leaders who question him risk legal action, judicial process and sanctions. Critics have been designated under presidential directives as “hostile to national interests”, “opposed to religious values” and “against free markets”, and menaced with legal action as “terrorists”.

The Justice System Transformed

Each situation involving prosecution of critics and protection for loyalists exhibits its own distinct features. But, regardless of their specific form, they exemplify manifestations of what has developed as a deliberate method. Such episodes are far from isolated. Trump's removal of Department of Justice prosecutors and Federal Bureau of Investigation officials, accompanied by his appointment of supporters in key posts, started quickly, promptly assumed a regularity, and has now been shaped into a regime. Federal prosecutors and the law enforcement agency have been transformed into partisan agencies under Trump's explicit command to execute his directives. Wrongdoing has been rendered standard. It represents the retribution system.

Management is preoccupied with punishing the leader's alleged adversaries than they are with safeguarding our public welfare.

Within the Apparatus

The foundation of this framework has been revealed in the legal complaint of multiple ex- top law enforcement officials filed in September in the US district court in DC against top official Kash Patel and top lawyer a key figure for unlawful firing in “a campaign of payback against them for what the accused considered to be a refusal to demonstrate sufficient devotion”. The document states that Brian Driscoll, the ex- acting FBI director, details a discussion in which the director “openly admitted the unlawfulness of his behavior”.

The official had attempted to shield law enforcement officers from being fired, the complaint states. The director told him that “White House figures” – understood by Driscoll to be the White House and federal prosecutors – had directed him to dismiss everyone who they considered as having participated in a law enforcement case against him. The filing continues: “The director stated that he had to dismiss the people his bosses told him to fire, because his capacity to keep his own role depended on the removal of the agents who worked on cases involving the President. Patel explained that there was no option he or him could do to stop these or any other terminations, because ‘the agency sought to place the leader in detention and he hasn't forgotten it.’” After the official informed Patel he was breaking the FBI's own policies, the director supposedly said “he knew that and he knew the essence of the summary firings were probably illegal”.

Widespread Impact

Since his claimed admission to Driscoll, the DoJ and the Federal Bureau have been dismantled and reorganized for the administration's retribution system. Six of the agency's senior executives were terminated or forced out in the early weeks of the administration. About numerous legal professionals at the justice department have agreed to a “deferred resignation program”. No fewer than seven federal prosecutors, among them those in the southern district of New York, stepped down in protest over what they viewed as ideological pressure in withdrawing the criminal prosecution against the local official, the mayor, in return for his collaboration with his ICE roundups of migrants. The ethics division of DoJ, which manages ethical violations, has been diminished to minimal staff. The rights protection unit has been severely reduced: seventy percent of its employees has departed. A third of top officials at DoJ have left. The unit enforcing environmental law has experienced the exit of a majority its supervisors.

Favors and Sanctions

Regarding the legal matter, the temporary lawyer for the federal division, the official, quit in objection against what she described as the “exchange”. A key figure, Trump's “enforcement chief,” showed up as the implementer with Adams on television to announce: “If he doesn't come through, I'll be back in the city.”. Meanwhile, a former official, earlier the justice department figure and a ex-lawyer, who arranged the agreement, was given an judicial position, a potential pathway to the highest court.

His protection for wrongdoings committed while in government, provided by the remarkable ruling of the GOP-led on the judicial body, thus blocking his legal action over the Capitol riot and preserving his electoral prospects for the national vote, is the foundation stone on which he stands to protect his supporters. Given this protection, he has been empowered to authorize wrongdoing. The consequence of the judicial ruling saturates his government and the GOP thoroughly. Trump v United States has spread. Similar to Richard Nixon's legal adviser the figure said about the Watergate
